Delivery, packaging, handling, insurance (if applicable), and shipping are not included. If shipment of the prize is requested and approved by Hammerhead Kayaks, the winner is solely responsible for paying the actual cost of packaging, handling, insurance (if applicable), and shipping prior to shipment. Accessories, registration, taxes, permits, transportation, and any other costs associated with ownership or use of the kayak are the sole responsibility of the winner. Payment of these costs must be received before the kayak is shipped. Hammerhead Kayaks is not responsible for delays, damage, loss, or claims arising during shipment. Ownership of and risk of loss for the prize transfers to the winner when the kayak is delivered to the shipping carrier. If the winner fails to claim the prize, arrange pickup, or pay any required shipping charges within fourteen (14) days after notification, Hammerhead Kayaks reserves the right to declare the prize forfeited and select an alternate winner.
Release of Liability By entering this giveaway, each participant agrees to release, waive, discharge, and hold harmless Hammerhead Kayaks, its owners, officers, directors, managers, employees, agents, representatives, affiliates, successors, assigns, sponsors, advertising and promotional agencies, and any other parties associated with this giveaway (collectively, the "Released Parties") from any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses of any kind, including personal injury, death, property damage, or other losses, arising out of or relating to participation in this giveaway or the acceptance, possession, transportation, shipment, ownership, or use of the prize. The winner acknowledges that kayaking and other outdoor recreational activities involve inherent risks, including but not limited to drowning, collision, falls, exposure to weather, equipment failure, serious bodily injury, permanent disability, and death. The winner voluntarily assumes all risks associated with the ownership and use of the prize. Hammerhead Kayaks makes no warranties or guarantees regarding the prize except for any applicable manufacturer's warranty that may accompany the kayak. Any manufacturer warranties are solely between the winner and the manufacturer. If the prize is shipped at the winner's request, Hammerhead Kayaks' responsibility ends when the prize is delivered to the shipping carrier. The winner assumes all risk of loss or damage during transit and is responsible for pursuing any claims with the shipping carrier.
